Description

Taught in English and with particular focus on common law jurisdictions, in Corporate Crime we study whether corporations should, in principle, be subject to criminal penalties, and how various jurisdictions go about imputing fault to entities with "no body to kick nor soul to damn". We review the key common law doctrines, relevant legislation including the UK Bribery Act and US Foreign Corrupt Practices Act and international instruments such as the OECD Anti-Bribery Convention. We finish the course by looking at the agencies responsible for prosecuting corporate bodies for crimes like bribery, corruption, terrorism financing, tax evasion, fraud, and market manipulation.
