Description

Starting from the observation of the conceptual disorder that prevails within Anti-discrimination Law, this course aims to clarify the different concepts it is made of and to identify some of the theoretical and practical challenges it faces today. Can the artisan baker argue his religious beliefs to refuse to serve a client ordering a celebration cake of a same-sex marriage? Should stereotypes always be tackled? Should prohibited criteria of discrimination be added? The idea that the right to non-discrimination cannot depart from contradictions, being guided by political objectives which are in opposition, makes its application by positive law necessarily complex (for example, the difficulty of linking standards guided by a need for substantive equality with those guided by a logic of formal equality). On the basis of concrete examples, the way in which legal actors, and in particular judges, combine the different policy objectives of non-discrimination law, will be measured.
