UK Constitutional law

Étudier la constitution du Royaume-Uni de Grande-Bretagne et d’Irlande du Nord, c’est se plonger dans un univers qui paraît étranger aux étudiants habitués aux constitutions écrites « rationnelles ». Le CM et les TD de ce cours permettront aux étudiants de comprendre les mécanismes par lesquels les « sources légales » (Statute law, Case law, European law) et les « sources non-légales » (conventions constitutionnelles, doctrine, écrits théoriques) fondent le droit constitutionnel britannique. Ils se familiariseront également avec les notions fondamentales de la constitution : the sovereignty of parliament, the rule of law, the separation of powers et devolution. La question de la protection des libertés publiques et des droits humains, avant et après le Brexit, sera également abordée. Au cours magistral sont adossées des séances de travaux dirigés lors desquelles les étudiants approfondiront les éléments étudiés en CM à travers diverses sources (textes de loi, sources doctrinales, décisions de justice, podcasts…) et s’exerceront à la synthèse et au commentaire de documents juridiques. To study the Constitution of the United Kingdom of Great Britain and Northern Ireland leads to immerse oneself into a world alien to students used to written, rational constitutions. The lectures and tutorials will enable the students to understand the mechanisms by which legal sources (Statute law, Case law, European law) and non-legal sources (constitutional conventions, doctrine, theoretical pieces) form the basis of UK constitutional law. They will also become acquainted with the fundamental doctrines of the British constitution: the sovereignty of Parliament, the rule of law, the separation of powers, and devolution. The question of the protection of civil liberties and human rights, before and after Brexit, will also be dealt with. As a follow up to the main lecture, the tutorials will allow the students to deepen their knowledge by studying various sources (statutes, doctrinal sources, court decisions, podcasts…) and practising the synthesis and analysis of legal documents.
